1. Definitions

1. “We”, “Us”, “Our”, “Code Gakko” refers to the Code Gakko platform and its operators.
2. “User” or “You” refers to any employee, administrator, or authorized person accessing the Service.
3. “Platform” refers to the Code Gakko application, systems, and associated services.

2. Account Registration & Security

Users must provide accurate and complete information when creating an account. You are responsible for:

1. Maintaining the confidentiality of your login credentials
2. Ensuring your account is used only by authorized individuals
3. Immediately notifying us of unauthorized access or security issues

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

1. Submit false, misleading, or unauthorized information
2. Upload unlawful, confidential, or harmful content
3. Attempt to access data belonging to others without permission
4. Reverse-engineer, copy, or modify the Platform’s code or functionality
5. Interfere with the proper operation of the Platform (e.g., hacking, DDoS)

The Platform is intended strictly for legitimate and authorized HR-related operations.

4. User Content

You may upload documents and data (“User Content”) necessary for HR and employment purposes.

By uploading User Content, you confirm that:

1. You have the right to provide the content
2. The content does not violate any laws or privacy rights
3. The content is relevant for legitimate HR processes

You retain ownership of your data. Code Gakko only processes User Content as described in our Privacy Policy.

5. Availability of Services

We strive to provide continuous access to the Platform, but we do not guarantee:

1. Uninterrupted or error-free operation
2. Preservation of all stored content at all times

Maintenance, upgrades, or technical issues may temporarily affect service availability.

6. Intellectual Property

All platform features, software, trademarks, UI designs, and content created by Code Gakko are our intellectual property. Users are granted a limited, non-exclusive, non-transferable license to use the Platform solely for internal HR functions. No rights are granted to copy, sell, resell, or distribute any part of the Platform without written consent.

7. Third-Party Services

Code Gakko integrates with third-party providers. Your use of the Platform may also be subject to their terms and policies. We are not responsible for actions or failures of third-party services.

8. Data Protection & Privacy

Our collection and use of personal information are governed by the Code Gakko Privacy Policy, compliant with the Singapore PDPA. By using the Platform, you acknowledge and agree to the processing of your data as described in our Privacy Policy.

9. Termination

We reserve the right to suspend or terminate access to the Platform if:

1. You violate these Terms
2. Requested by your employer or authorized administrator
3. Required by law or regulatory authorities

Upon termination, some data may be retained for compliance and record-keeping purposes.

10. Limitation of Liability

To the fullest extent permitted by law, Code Gakko shall not be liable for:

1. Indirect, consequential, punitive, or special damages
2. Loss of income, business opportunities, or data
3. Downtime or service disruptions

Users assume all responsibility arising from use of the Platform.

11. Indemnification

You agree to indemnify and hold harmless Code Gakko from any claims, damages, or liabilities arising from:

1. Your misuse of the Platform
2. Your violation of these Terms
3. Your uploaded content

12. Amendments to Terms

We may update these Terms periodically. A “Last Updated” date will indicate changes. Your continued use of the Platform signifies acceptance of revised Terms.
